OPS Line – Shipping Terms & Conditions

1. General Scope

OPS Line provides a wide range of logistics and shipping services including ocean freight forwarding, NVOCC operations, ship agency, customs clearance, warehousing, inland transportation, and project cargo handling. These Terms & Conditions govern all contracts and services between OPS Line and its clients unless otherwise agreed in writing.

2. Ocean Freight Forwarding and NVOCC Services

2.1 Booking & Cargo Handling: Cargo bookings are subject to space availability and confirmation by the carrier. Clients must provide accurate shipment details, including weight, dimensions, and hazardous material declarations if applicable. OPS Line is not responsible for delays or damages resulting from incorrect or incomplete information.
2.2 Documentation: Clients are responsible for submitting all required shipping documents (Commercial Invoice, Packing List, Export/Import declarations, Certificates of Origin, etc.) on time. OPS Line will assist with documentation but is not liable for penalties or delays due to client errors or omissions.
2.3 Liability & Insurance: OPS Line acts as a freight forwarder and NVOCC and is liable only for proven negligence. Liability limits are governed by international conventions (e.g., Hague-Visby Rules) or applicable laws. Cargo insurance is the responsibility of the client unless explicitly arranged.
2.4 Freight Charges & Payment: Freight rates are subject to change due to fuel surcharges, currency fluctuations, or carrier amendments. Payments must be made according to agreed terms; late payments may incur interest or suspension of services.

3. Ship Agency Services

3.1 Agency Scope: OPS Line acts as an agent for vessel owners/operators, handling port calls, customs formalities, and coordination of services. The company does not assume liability for vessel operation or cargo damage unless caused by gross negligence.
3.2 Fees & Expenses: Agency fees and disbursements will be billed as agreed; non-payment may result in withdrawal of services. Client must provide timely and accurate vessel and cargo information to facilitate smooth operations.

4. Customs Clearance & Documentation

4.1 Compliance: Clients are responsible for complying with all import/export regulations and providing correct information for customs declarations. OPS Line facilitates customs clearance but is not liable for fines, penalties, or delays due to inaccurate data or non-compliance by the client.
4.2 Documentation: Proper and timely submission of documents (Invoices, Packing Lists, Licenses, Permits) is required to avoid clearance delays.
4.3 Duties & Taxes: Import duties, taxes, and customs charges are the responsibility of the client unless otherwise agreed.

5. Warehousing and Inland Transportation

5.1 Storage & Handling: OPS Line provides warehousing services under standard industry practices and is liable only for negligence. Clients must inform OPS Line of any special handling or storage requirements.
5.2 Inventory Management: OPS Line maintains inventory records and coordinates timely dispatch but is not responsible for losses due to client-supplied inaccurate information.
5.3 Transportation: Inland transportation is managed with due care; however, OPS Line is not liable for delays or damages caused by third-party carriers.

6. Project Cargo & Special Handling

Project cargo handling requires detailed planning and risk assessment. OPS Line provides expert advice but final responsibility for cargo readiness rests with the client. Due to the nature of project cargo, OPS Line’s liability is limited; clients should ensure adequate insurance coverage.

7. General Liability & Indemnity

OPS Line’s liability for loss, damage, or delay is limited to the extent provided under applicable international conventions or local laws. Clients agree to indemnify OPS Line against claims arising from inaccurate information, illegal shipments, or breach of regulations.

8. Force Majeure

OPS Line is not liable for delays or failures caused by events beyond its control, including natural disasters, strikes, war, terrorism, government restrictions, or transportation disruptions.

9. Payment Terms

Payment is due as per the agreed terms on the invoice. OPS Line reserves the right to suspend services if payments are overdue. Clients are responsible for all bank charges related to payments.

10. Governing Law & Jurisdiction

These Terms & Conditions shall be governed by the laws of the jurisdiction where OPS Line is registered. Any disputes will be resolved in the competent courts of that jurisdiction.
